The reduced EB-5 capital amount applies to investments in a targeted employment area or a qualifying infrastructure project, and neither status follows automatically from a project being rural or geographically remote. The regulation requires evidence that the investor's capital was obtained through lawful means, and USCIS reads that as a request to trace the funds back far enough to be satisfied about their origin. EB-5 requires qualifying capital placed at risk in a new commercial enterprise, the required job creation under the applicable model, and compliance with the immigrant process; an ordinary investment return expectation does not replace those elements. Any proposed contribution of a receivable or binding future payment arrangement needs legal analysis of the actual asset, ownership, value, commitment and applicable capital rules. Current USCIS policy treats lawfully obtained loan proceeds contributed as cash rather than requiring the loan to be secured by the investor's own assets, although the lawful source, path and genuine loan terms must still be documented.
