A purchase does not itself establish the spouse’s work permission. Qualifying E spouses may be employment-authorized incident to status with appropriate evidence.
Review the person as well as the transaction
Identify the spouse’s actual status and planned activity. Do not substitute the principal’s ownership papers for the spouse’s immigration documentation.
Where a spouse is expected to hold a management role, verify the dependent classification and the proof the business will rely on, and record each family member's nationality, relationship, and intended arrival so the household plan and the opening schedule stay aligned. Children hold no employment authorization through dependent status, and family members may receive appointments and decisions on different dates, so avoid plans that assume everyone travels together. Children stop qualifying as derivatives at twenty-one, and a treaty investment can run for many years, so a family with a teenager should assume that a separate status will eventually be needed and plan the timing rather than react to it. Note one point that surprises owners: owning the company does not by itself authorize you to perform work in the United States — the authorization comes from your status and its terms, which is exactly what repeated absences can put in question.
