The official gift framework should not be described as a recoverable commercial investment. The September 7, 2026 official processing fee is US$15,000 per person and nonrefundable; the principal gift is US$1,000,000 individually or US$2,000,000 for a corporate-sponsored employee. Family and continuing corporate obligations are additional.

EB-5 involves its own capital-at-risk and job requirements. Keep gifts, charges and commercial investment risk distinct and confirm current official terms.
Build a dated review file around the current official fee notice, required gift payment instruction, payer records, currency and transfer evidence, and any separate professional costs. Everything else — translators, counsel, medical examinations, courier and travel — is private commercial spending negotiated with a provider, and none of it is an official programme charge however an invoice describes it. As published, each accompanying spouse and each unmarried child under twenty-one adds a further nonrefundable processing fee and a further US$1 million gift, so a household's total is a multiple rather than a small increment. Follow verified official instructions, and assess tax and financial consequences separately rather than importing proposed programme benefits or an investment repayment assumption. Retain the official instruction, payment confirmation and the records identifying whose application each amount concerns; do not describe the gift as an investment or as consideration for a guaranteed immigration result.
