THE SHORT ANSWER

Canadian permanent residence describes a Canadian immigration position, not a universal entitlement to US professional or investor classification. Begin the comparison with actual citizenship, the proposed activity and the relevant route conditions.

Read the citizenship record separately

A Canadian permanent resident might hold citizenship that supports one route and not another. TN requires Canadian or Mexican citizenship. A Canadian permanent-resident card, years of residence or an expected future citizenship application does not supply that requirement. Record any multiple citizenships accurately instead of selecting a nationality simply because it seems convenient.

Identify the nationality question for the business

E-2 requires treaty nationality and generally at least 50 percent qualifying treaty-national ownership of the enterprise, alongside substantial committed at-risk investment, development and direction, and a real nonmarginal operation. The investor’s Canadian address does not establish enterprise nationality. Use the actual owners and their citizenship evidence rather than the place where a company bank account is held.

Compare the employment history where nationality is not the main gate

L classification generally does not require Canadian citizenship, but it needs the qualifying company relationship, continuous foreign employment year and appropriate role. A residence card cannot establish those facts either. Record which requirements are supported now and which would depend on a future event before making a travel or employment commitment.
