Describe the appointment beyond its title

Hypothetical example: an applicant receives a university appointment involving teaching, laboratory support and administrative duties. Obtain the actual allocation and the institution’s requirements. Identify the appropriate listed profession on those facts; an academic setting does not automatically turn every job into a qualifying teaching or scientific role.

Check what the credential establishes now

TN requires Canadian or Mexican citizenship and the prescribed qualifications for the relevant profession, including any expressly permitted alternatives. A pending degree is not the same as an earned qualification. Explain the actual award date and available records. Degrees from institutions outside Canada, Mexico and the United States require a reliable evaluation; US practice-licensing requirements must be considered separately.

Identify the arrangement behind the appointment

Set out the employer, services, remuneration and intended duration. Clarify any separate consulting work rather than treating the appointment as unrestricted US work permission. Providing services to a US entity solely owned or controlled by the applicant falls outside the permitted TN arrangement; foreign ownership alone is not a blanket exclusion.

Use the term dates as planning inputs

Temporary professional activity and the other requirements must all be established. A semester end does not cure missing qualifications. Canadian citizens generally do not need a TN visa, whereas Mexican citizens generally do; the appropriate process and admission still require review. Keep travel, orientation and paid work tied to their actual permissible activities.

Apply the specific credential rule for the listed profession

The listed entry is satisfied either by a baccalaureate degree in hotel or restaurant management, or by a post-secondary diploma or certificate in that same field combined with three years of experience in hotel or restaurant management. Officers compare the credential presented with the credential the listing names for that profession, and a technology diploma is not a baccalaureate in engineering however similar the coursework. USMCA Appendix 2 lists "engineer" with its own credential path: a baccalaureate or licentiate degree in engineering, or a state or provincial licence. TN turns on the credential alternatives written into the specific profession's listing, not on a general notion of equivalency, so counsel should confirm which alternative the applicant is relying on before anything is drafted. Experience cannot universally replace education, and a reference letter should not claim duties or credentials the person did not actually have. Several enumerated professions name recognized professional credentials as an alternative to a degree, so the first step is to read the entry that applies and confirm which route the file will rest on. Course catalogue excerpts can illuminate a field of study, yet cannot make a diploma satisfy a degree-only occupation. A Canadian professional may request TN classification at a border inspection point or preclearance facility; if USCIS is the selected procedure, the U.S. employer files Form I-129 directly with that agency.
