Baldwin funding comparison: a family gift is not the same as the Gold Card gift

THE SHORT ANSWER

A parent’s gift used to fund an EB-5 investment and a gift made under Gold Card describe different transactions. Trace where the money goes, what rights it creates and which immigration requirements remain.

Follow the private funding into EB-5

A genuine family gift can be part of a funding history, with lawful source and path established. The resulting EB-5 capital must meet the applicable amount and at-risk conditions, with ten qualifying full-time jobs per investor under the applicable method and required management or policy participation. Current thresholds are US$1,050,000 or US$800,000 for a qualifying targeted employment area or infrastructure investment; scheduled adjustment begins January 1, 2027 based on petition filing date.

Identify the separate government gift process

Gold Card processing is US$15,000 nonrefundable per person. After vetting when instructed, the gift is US$1 million individually or US$2 million per corporately sponsored employee. Each eligible included spouse or unmarried child under 21 adds US$1 million and US$15,000, including corporate cases. Corporate terms include 1% annual maintenance and 5% transfer with a new background check, not automatic replacement approval. EB-1 or EB-2 eligibility, admissibility and visa availability remain. The government gift provides no EB-5 equity interest, job allocation or promised return.

Compare the documentary consequences

For the EB-5 funding, retain the donor history, gift agreement, transfers and investment rights. For Gold Card, retain the official notice, applicant identity and payment-stage evidence. Under neither route does a payment receipt itself establish residence or work permission. EB-5 conditional residence starts with immigrant admission or adjustment approval; its later I-829 process is distinct from the original family gift and does not itself guarantee capital recovery. I-829 generally must be filed in the 90 days before the second anniversary of conditional residence. Filing does not automatically remove conditions or compel repayment.
