Start with the L-1A eligibility and application overview
Distinguish the announcement from the effective role
Identify the decisions the applicant will make, the organization or essential function managed and the staff or other resources carrying out the underlying work. A managerial title cannot substitute for primarily managerial or executive duties. Senior oversight can exist without the applicant personally doing every operational task.
Establish the employment and corporate foundation
The transfer needs qualifying parent, subsidiary, affiliate or branch organizations and regular, systematic and continuous business in the United States and another country. Establish the required continuous full-time qualifying foreign year within the relevant three years. U.S. days do not count toward that year, although qualifying brief trips need not interrupt continuity. Ordinary L-1A can use managerial, executive or specialized-knowledge foreign work; the U.S. managerial or executive capacity must be established independently.
Apply the new-office rule only to the actual organization
Where the qualifying U.S. organization has been doing business for less than one year, new-office L-1A specifically needs managerial or executive employment during the qualifying foreign year, sufficient premises and support for the U.S. role within one year of approval. Initial new-office approval is at most one year. Owners or major stockholders also need evidence of temporary U.S. services followed by an assignment abroad.
Managerial or executive duties, not general operational involvement
An executive directs the management of the organization, sets goals and policies, exercises wide discretion and receives only general supervision from a board or shareholders. Executive duties involve directing management, setting goals and policies, and exercising wide latitude in discretionary decision-making. Managing people means directing subordinate supervisors or professional staff, with authority over hiring, firing and their day-to-day direction. A service-delivery director who sets staffing levels, approves client contracts, hires and disciplines engineers and controls the operating budget is managing an organization or function at a senior level. Provide an organization chart of the U.S. company from payroll, showing branch managers, an agronomist and an office manager reporting to the general manager. Use calendars, approval records, budgets, delegation instruments, and descriptions of subordinate functions to show how authority operates. A useful first review ends with a proposed organization chart for the first six months, naming who performs the operational work and who reports to the transferee. Before deciding to file, map every claimed supervisory responsibility to a dated delegation, organization chart, and the name of the person who carried out the underlying task.
Establish the foreign role and period
The petitioning entity and the foreign employer must stand as parent, branch, subsidiary or affiliate, and affiliation through common ownership must be shown with the registers, shareholder agreements and any trust or holding arrangements that establish it. L-1A status is available for a maximum of seven years, and a new-office petition is normally approved for one year at first, with the extension assessed against what the office has actually become. Access to the managerial maximum involves applicable requirements; a promotion label does not automatically grant additional time. L-1A preparation should describe what happens during those visits and how the full role is primarily managerial or executive, without treating all customer contact as either disqualifying or automatically strategic. The record should show secured physical premises and a credible plan for operations that can support a managerial or executive position after that period. A contract does not automatically establish that the applicant primarily manages rather than performs the operation’s work.
