Does an L-1A approval automatically give the spouse proof of work authorization?

A qualifying L spouse may be employment-authorized incident to status, but the spouse’s own status and appropriate documentation matter.

Do not rely only on the principal’s approval. An employment authorization document is not universally required for qualifying L spouses; dependent children do not gain work permission solely through L status.

A spouse may take employment anywhere, including work unrelated to the family business, which often stabilises a household's income during a first year when the new operation is consuming cash rather than producing it. Children in L-2 may attend school but may not work, and their eligibility ends at twenty-one, so a household with an older teenager should map that person's own route early rather than assume the family status covers them. Where relatives genuinely do work, the arrangement should appear in ordinary business records: an employment agreement or engagement letter, payroll entries, and evidence of the authorization each person relies on. Children are derivatives only while unmarried and under 21, and a child who reaches that age during the assignment loses derivative status and needs an independent basis to remain, which is worth mapping against a seven-year ceiling rather than against the first petition.
