Identify when the responsibilities change

Review the concrete role and applicable established-office or new-office requirements. Do not present projected staffing as completed history or assume a business target guarantees approval timing.

The company needs to prepare evidence of the proposed operation itself, not just the individual and the corporate relationship, and that means reviewing premises, staffing, and financial capacity before treating a planned launch date as a guaranteed immigration outcome. Ask for four dates in writing: when the applicant's employment with the current entity began, when any transfer of the business unit takes legal effect, when employment with the receiving entity begins, and when the filing or the intended admission would occur. If planned hires are late, identify interim authorized workers or vendors, recalculate how much operational work the transferee would personally perform, and decide whether the filing date or requested role must change. In every case, verify one continuous year abroad within the prior three, the qualifying corporate relationship, continuing foreign business and primarily managerial or executive U.S. duties. Explain actual commitments, ordinary work allocation and expected managerial responsibilities without promising that commercial delays extend the authorized period.
