Identify employer-related processes, products or services and the applicant’s actual contribution. General seniority is context rather than a complete eligibility analysis.
Beyond the usual requirements — the qualifying corporate relationship, the qualifying employment period abroad, and special knowledge — offsite placement raises restrictions concerning who supervises the employee and whether the placement is essentially labour for hire. Reconstruct when the employee acquired and applied the company-specific knowledge, using assignments, training, product versions, problem records, and supervisor accounts rather than the date printed on a new title. Identify the company-specific product, process, procedures, international application, and refinements the worker understands; then show why that command is special or advanced compared with knowledge ordinarily found in the organization or field. The transferee must have been employed by the qualifying organisation abroad for one continuous year within the three years before filing, and the American and Canadian entities must stand in a parent, branch, subsidiary or affiliate relationship with both actively doing business.
