Should we transfer the gift before collecting its history?

Assess the evidence and transaction obligations before making an irreversible commitment. An early transfer does not cure an undocumented source.

Plan both records and milestones

Identify missing donor records, expected transfers and the intended petition date. A payment does not lock every future requirement or start conditional residence. Keep the later admission or adjustment event and I-829 timetable separate from the donor’s preferred gifting date.

Payroll for the qualifying positions, the enterprise’s continued operation, and proof that the capital stayed at risk rather than being returned early are all being generated during those months, and the petition to remove conditions is assembled from them. The I-829 stage asks for evidence concerning the investment and job-creation requirements, so maintain project reports, bank and subscription records, enterprise records, tax documents where relevant, and communications that explain material business changes. How quickly the investor integrates and grows the acquired business affects the job-creation evidence available at removal of conditions, but petition adjudication and visa availability are independent government processes with their own timelines. Plan the enterprise's own reporting on the same staggered basis, because each investor will eventually need to demonstrate that their capital was invested and sustained on the terms required, and that demonstration is easier when the records were kept per investor from the start.
