Funding alone does not make a sibling an eligible joining family applicant. The person’s own immigration position needs assessment.

Separate financial support from eligibility

List the proposed principal, eligible spouse and unmarried children under 21, with actual relationship and age records. Do not assign a family fee to someone merely because they share the household budget. Any independent application must be assessed on its own requirements rather than assumed covered by the principal’s gift.

The official program page separately states that an applicant must be eligible for lawful permanent residence, admissible to the United States and have an available visa; background and security checks, medical examination and the consequences of prior immigration or criminal history therefore remain relevant. Under the official framework and Executive Order 14351, the qualifying gift is treated as evidence of relevant EB-1 or EB-2 eligibility; the page does not require a separate conventional career-profile showing before application. The official framework involves government vetting and an eligibility determination under an existing immigrant category, and any ground of inadmissibility, such as immigration violations, criminal history or security concerns, applies regardless of the payment. Because the case still proceeds through EB-1 or EB-2 classification, eligibility, admissibility, and visa availability remain live questions that a hiring budget cannot resolve; recruiting spend is also not EB-5 investment capital and creates no job-creation credit.
