Can my spouse take a US position while I manage the function?

THE DIRECT ANSWER

A qualifying L spouse is employment-authorized incident to valid L spousal status with appropriate evidence. The principal’s management assignment does not itself grant that status to the spouse.

Check the individual admission record

Confirm classification and validity, including the relevant spouse-designated I-94 where applicable. Unmarried children under 21 may qualify as dependents but do not receive the spouse’s work authorization. Keep each person’s employment or study plans separate from the company’s management schedule.

Record the citizenship, relationship evidence, and intended activities of the applicant's actual accompanying family members, keeping that analysis distinct from any family relationship that may exist between the business owners on either side of the transfer. The single most useful thing a family can do is verify what appears on each arrival record when they enter, rather than months later when a spouse has a job offer and the record turns out to say something unexpected. Practical steps still matter — employers will need to see documentation acceptable for employment verification — so the family should raise this early rather than assuming a new employer will understand the position. Age is the condition to watch: dependent status is available only while a child is under twenty-one and unmarried, so a household with a nineteen-year-old should plan for a change to student status well before the birthday rather than in the month it arrives.
