Explain who does the underlying work

Identify the essential function, the applicant’s senior authority and the employees or arrangements carrying out operational tasks. Provide examples of management decisions. A claim that the applicant manages a function is incomplete if the evidence primarily shows the applicant personally delivering that function.

A person who directs thirty dock workers and drivers feels unmistakably managerial in ordinary language, yet the definition specifically excludes first-line supervision of employees who are not professionals unless the supervised staff are themselves supervisory. For both people, confirm one continuous year of qualifying employment abroad during the relevant three-year period and a parent, branch, subsidiary, or affiliate relationship, with the foreign organization doing business; for a new-office L-1A petition, that foreign year itself must have been managerial or executive.
