Can a TD spouse help finish client designs from the U.S. home?

THE DIRECT ANSWER

TD does not authorize employment. A Canadian payer or unpaid description does not itself permit professional services performed in the United States.

Keep the spouse’s work outside the principal’s authorization

An eligible spouse and unmarried children under 21 may seek TD and may study, but the principal’s design assignment is not shared work permission. Describe the spouse’s actual planned contribution and assess the spouse’s own appropriate status before promising it to the client.

Review a child's schooling and any age-related question separately from the spouse's employment question, and clarify whether the household plans to arrive together or in stages so each person's documentation can be prepared accordingly. Avoid encouraging a spouse to resign from current work or committing to a school year abroad based on this offer alone until independent supervision is documented and the arrangement looks presentable as qualifying employment rather than self-employment. Adding a second employer does not usually change dependent status directly, but any disruption to the first employer's authorization while arranging the second could indirectly affect dependents, so keep both employer relationships clearly documented and stable.
