Start with the L-1A eligibility and application overview
Describe the actual scope of discretion
Identify the organization or essential function managed, significant decisions delegated to the applicant and matters reserved for higher approval. Explain who performs ordinary production or service tasks. A primarily managerial or executive role can involve oversight from others; a budget title alone also cannot prove qualifying capacity.
Connect the role to qualifying employment and entities
Establish the continuous full-time qualifying foreign-employment year within the relevant three years and the parent, subsidiary, affiliate or branch relationship. Ordinary L-1A may use managerial, executive or specialized-knowledge employment abroad while the U.S. duties must be managerial or executive. The qualifying group must conduct regular, systematic and continuous business in the United States and another country. U.S. days do not count toward the foreign year, although qualifying brief trips need not interrupt continuity.
Assess new-office development separately from the budget
If the qualifying U.S. organization has done business for less than one year, new-office L-1A needs the qualifying foreign managerial or executive year, sufficient premises and support for the U.S. role within one year of approval. Initial approval cannot exceed one year. For an owner or major stockholder, include evidence of temporary U.S. services and a subsequent foreign assignment.
Managing people and managing a function are different claims
The petition should state what proportion of the transferee's time will go to managing people or a function, setting policy, hiring and firing, and budget authority, and what proportion to hands-on operational tasks. A production manager who supervises fourteen people, sets shift schedules, approves purchases and disciplines staff is doing managerial work. For a manager that means directing the organisation or a department, supervising professionals or other managers, holding authority to hire and fire, and exercising discretion over daily operations. A director of golf operations who will direct a general manager, a superintendent and a food and beverage manager fits the first branch comfortably, and the organizational chart makes the argument. Essential-function management requires senior responsibility rather than chiefly performing delivery work. L-1A status is generally subject to a seven-year maximum, so the review also needs the applicant’s prior L time and any recapture question; a senior title cannot answer either issue. Provide the organisation chart with the subordinates' own roles described, since a manager who supervises other professionals or supervisors is in a very different position from one whose team performs routine work. Where the subsidiary is small, an essential-function theory may fit better than a personnel-management one, but it has to be described honestly and supported by what the operation actually looks like.
Show real management rather than ordinary first-line supervision
An executive directs the management of the organization, sets goals and policies, exercises wide discretion and receives only general supervision from a board or shareholders. Parent and subsidiary, branch, or affiliates under common ownership and control are the qualifying forms, and long collaboration is not one of them. Where an employee primarily supervises staff who are neither professional nor themselves supervisory, the statute treats that person as a first-line supervisor rather than a manager, unless the employees supervised are professionals. A president who sets the capital plan, approves grain contracts and hires the operations manager is describing executive work; the same person driving a truck in September and calling it executive is not. The analysis should determine whether the actual proposed role primarily meets managerial or executive requirements, not whether the promotion is commercially deserved.
