The software’s availability does not decide the case. Establish the relevant special or advanced organizational knowledge and the U.S. role that uses it.
Explain the organizational application
A Killarney applicant should describe the company’s processes, decisions and implementation experience. Do not claim that a widely sold platform is proprietary or assume a vendor qualification proves advanced company knowledge.
A qualifying relationship, one continuous year of qualifying employment abroad in the previous three years, and a U.S. position requiring specialized knowledge of the company's own process rather than general professional skill. Configuration and change histories, authorship records for internal procedures, training materials and completion records, an organizational chart, and a signed statement quantifying how many staff hold comparable knowledge. Knowledge of the employer's own product and how it is configured, commissioned and supported is the type of knowledge L-1B contemplates, provided it is genuinely distinct from what others in the industry hold and the worker has one continuous qualifying year with the company abroad. The record should explain why the deliverables call for someone who knows the product from the inside, without claiming that the knowledge is unique or that nobody else could ever learn it — neither is required, and overstatement invites challenge.
