A Markstay-Warren applicant may receive money from a parent for EB-5 while an employer discusses Gold Card sponsorship. Separate the private family gift from the programme’s government gift. The fact that both arrangements involve someone else providing money does not make their legal or financial consequences equivalent.
Trace the EB-5 donor before assessing the project
Document the donor’s lawful source, the genuine gift terms and the full transfer path into qualifying at-risk capital. EB-5 generally requires US$1.05 million or US$800,000 for qualifying targeted employment area or infrastructure cases; statutory adjustments begin January 1, 2027, so check the filing-date rules. At least ten qualifying full-time jobs per investor and management or policy-formulation participation remain necessary. Family generosity cannot replace the project evidence or guarantee repayment.
Read the corporate Gold Card proposal under its own terms
Published processing is US$15,000 nonrefundable per person; after vetting when instructed, gifts are US$1 million individually or US$2 million per corporately sponsored employee. Each eligible spouse or unmarried child under 21 adds US$1 million and US$15,000, including corporate cases. Corporate terms add 1% annual maintenance and a 5% transfer charge with a new background check. Reuse of a prior contribution does not automatically approve a replacement. EB-1 or EB-2 eligibility, admissibility and visa availability still apply.
Separate repayment expectations from residence milestones
The Gold Card gift provides no commercial equity or promised return. EB-5 petition approval alone is not residence or work permission; conditional residence is followed by I-829, generally during the 90 days before its second anniversary. Filing does not automatically remove conditions or require repayment. Read any private obligation to a parent or employer separately from the immigration process. Neither route guarantees citizenship, approval or a date when the household can move.
