Determine whether the US office is legally new

The framework concerns a US organization doing business for less than one year, not simply a recently renamed department. Prove the qualifying company relationship and continuing regular, systematic business in the United States and abroad. Document a continuous full-time foreign employment year within the relevant three years, excluding US days while not automatically treating brief visits as interruptions.

Apply the correct foreign-role and US-role conditions

New-office L-1A requires the qualifying foreign year specifically to have been managerial or executive. Ordinary L-1A may also rely on qualifying foreign specialized-knowledge service, but that broader foreign-capacity rule does not remove the new-office condition. Secure sufficient premises and show how primarily managerial or executive work will be supported within one year of approval. Identify who places routine orders and follows up suppliers while the transferee manages the function.

Keep the plan tied to the initial approval period

Initial new-office approval is limited to one year. If the proposal is L-1B, establish specialized knowledge, sufficient premises and financial ability to compensate the employee and begin business. For either route, mark accepted staffing arrangements separately from future recruitment. If operational work falls back onto the transferee, explain the effect on the claimed duties rather than preserving an obsolete allocation. A revised forecast does not extend the initial period automatically.
