Describe the knowledge through an actual task
In a hypothetical assignment, the employee diagnoses failures by applying the company’s internal integration rules rather than simply operating standard software. Identify what those rules cover, how the employee learned them and which work examples demonstrate depth. Knowledge need not be unique or proprietary, but ordinary familiarity, seniority or a training certificate alone does not establish the required special or advanced character. Explain the comparison with relevant industry or company knowledge accurately. The statutory standard covers special knowledge of the company’s products, services, research, equipment, techniques, management or other interests and their application in international markets, or advanced knowledge or expertise in its processes and procedures.
Prove the qualifying employee and organization history
L-1 requires a qualifying corporate relationship and a continuous full-time foreign employment year within the relevant three years. Exclude US days from the foreign-year count without assuming brief trips automatically break continuity. Qualifying foreign service may be managerial, executive or specialized knowledge; the proposed US work must meet the L-1B knowledge standard. The organizations must continue regular, systematic and continuous business in the United States and abroad during the relevant stay.
Investigate who will control an off-site assignment
If the employee will be stationed primarily at an unaffiliated worksite, L-1B is unavailable where that unaffiliated employer principally controls and supervises the employee, or the arrangement is essentially labour for hire rather than a placement connected with the petitioning employer’s specialized-knowledge product or service. Read the actual supervision, task allocation and service obligations. Keeping payroll in Canada does not cure a disqualifying arrangement or explain who directs the work.
Match the plan to the office and evidence available
A US organization doing business for less than one year is a new office. L-1B new-office evidence includes sufficient premises, the requisite knowledge and financial ability to pay the employee and commence business; initial approval is limited to one year. For any assignment, describe what the transferee will perform and how training or handover fits. Do not turn the expected time to train someone else into an automatic qualification rule.
Explain the specific knowledge and assignment
Assignments performed mainly at a third party's site carry specific restrictions concerning who supervises the worker day to day and whether the arrangement amounts to placing labour for hire. If part of the assignment will occur at a municipal client's plant, the petition must show the transferee remains directed and controlled by the petitioner, performing work involving its specialised knowledge, rather than being supplied as labour to the client. What supports the petition is knowledge tied to something the organization itself created or developed: internal specifications, a proprietary configuration, a method documented only inside the company, or an equipment adaptation that does not exist elsewhere. Start with the information itself: controlled manuals, system architecture, revision history, technical training and examples of unusual problem-solving. Product manuals, training records, project histories and declarations from informed supervisors can explain the knowledge without relying on a claim that no colleague could ever do the work. The file should explain what the beneficiary knows, how it is special or advanced, how it was obtained and why the proposed duties require it; proprietary material can support that explanation without becoming a mandatory element.
