THE SHORT ANSWER

For a St.-Charles family, a missing or inconsistent document should be addressed through an accurate relationship account and the applicable instructions. Do not treat a principal’s employment or payment as a substitute for each relative’s eligibility.

Identify the relationship and the evidence needed

Dependent categories generally cover a spouse and unmarried children under 21; applicable immigrant age protection requires assessment of actual dates. Ask the legitimate issuing authority about the unavailable record and follow case-specific evidence instructions. A relative’s financial dependence or shared surname alone does not establish the required relationship. Immigrant child-age protection does not extend the ordinary TD, E or L dependent child age limit.

Separate eligibility from work permission

TD permits study but not work. Qualifying E or L spouses may work incident to appropriate status with the required evidence, but children do not receive that spouse permission. Check the individual admission or status record rather than relying only on the principal’s approval. A planned role in a family business still requires the person’s actual authorization.

Coordinate the immigrant household without assuming a shared decision

For EB-5 or Gold Card, filing or payment alone does not grant residence. Immigrant-visa derivatives enter with or after the principal. Gold Card adds US$1 million and US$15,000 nonrefundable processing per eligible included spouse or unmarried child under 21, including corporate cases; initial inclusion is recommended. A missing record request does not automatically extend a deadline or guarantee everyone can travel together.
