THE SHORT ANSWER

An evidence file should distinguish Canadian permanent residence from the citizenship and substantive facts relevant to a U.S. route. Begin with the individual’s actual identity and proposed activity, rather than assuming every resident of Canada uses the same process.

Identify what each document proves

Hypothetical example: a permanent resident has a Canadian residence card and a U.S. job offer. The card concerns Canadian status; the offer describes proposed work. Neither alone establishes TN eligibility, which requires eligible Canadian or Mexican citizenship and the applicable professional requirements. Record the actual citizenship and qualifications separately.

Build a route-specific evidence request

For a possible L transfer, identify the qualifying company relationship, foreign employment and U.S. role. For E-2, examine treaty nationality, the enterprise and qualifying investment. Do not request a generic collection of papers while leaving the essential arrangement undefined, or describe either route as automatically available to Canadian permanent residents.

Include the household before arranging the process

Record each person’s citizenship, relationship and intended work or study. Their documentation and process may differ. Confirm the steps appropriate to the actual case before relying on travel plans. A Canadian residence document does not grant U.S. work permission, and an intended future application does not authorize current activity.
