Name the actual applicant and route
Hypothetical example: a company offers to fund an employee while the employee’s spouse is included in a personal relocation budget. Identify the sponsored employee and each proposed joining family member separately. Gold Card uses an individual or corporate gift pathway within EB-1 or EB-2 eligibility, admissibility and visa-availability conditions; it is not an EB-5 business investment.
Match each payment to official instructions
The official FAQ states a US$15,000 nonrefundable processing fee per person. Following successful vetting and official instructions, the gift is US$1 million for an individual principal or US$2 million for a corporate-sponsored employee. An eligible joining spouse or unmarried child under 21 has a separate US$1 million gift and US$15,000 processing fee. Keep each person and payment stage identifiable; a consultant’s invoice is not the government decision. Those additional family amounts also apply under corporate sponsorship; additional visa-related charges may apply under the official instructions.
Read the company’s continuing terms
Corporate sponsorship includes a 1 percent annual maintenance fee and a 5 percent transfer fee under the official terms. A replacement employee requires a new background check and cannot be assumed approved merely because the company already paid for a previous employee. Record who would carry these obligations, without presenting an internal reimbursement agreement as a change to the government requirements.
Avoid borrowing features from another route
The gift is not an EB-5 equity interest with project returns or job-creation allocation. A payment does not automatically confer residence, permission to work or a tax outcome. Use the current official FAQ for process instructions and assess the actual applicant’s EB-1 or EB-2 route and admissibility; do not substitute claims about a different proposed product.
Confirm the other requirements still apply
Because the programme runs through existing employment-based classifications rather than a new one, the ordinary requirements of the classification used still apply, as do the ordinary grounds of inadmissibility. Follow the official instructions received for the gift instead of sending assets to a wallet address supplied by an unverified message. The payment moves in one direction only, from the applicant to the U.S. government, and it purchases neither a classification nor a waiver of any ground of inadmissibility. Do not assume that a private adviser or one partner has completed an official update without confirming the actual action. Write down, once, where each thing lives: the official account and its reference, the address recorded on it, the payment records, and any private copy an adviser or employer holds. Confirm the recipient, amount, timing, and written official instruction before sending money; retain the payment confirmation and the communication that authorized it. Under the official framework and Executive Order 14351, the qualifying gift is treated as evidence relevant to the specified EB-1 or EB-2 basis; the applicant must still be eligible for lawful permanent residence, admissible and have a visa available. The most damaging mistake available to an applicant is to pay someone other than the official channel; a gift that never reaches the U.S. government is simply lost money, and the program has not been applied for at all.
Sequence the vetting, the instructions and the payment
The official program operates through EB-1 or EB-2, as appropriately determined by the responsible agencies and subject to visa availability. The official sequence runs from application and fee through vetting, the gift when instructed, and an EB-1 or EB-2 determination. Gold Card materials should be read as the official program describes them, not as a conventional visa category. What goes wrong is assuming that a payment, corporate support, or a charitable history replaces admissibility, visa availability, screening, or the underlying immigrant-category requirements. A sponsor, employer or bank can assist with logistics only after the payment source, applicant responsibility and official instructions are clear.
