Can my company sponsor me simply because it can afford the gift?

THE DIRECT ANSWER

Financial capacity does not eliminate the applicant’s eligibility, vetting, admissibility or visa-availability requirements.

Separate the company decision from the immigration decision

Identify the actual sponsored employee and the EB-1 or EB-2 basis being assessed. A board approval to spend money is evidence of the company’s intention, not an approval of the employee. Confirm the official corporate process rather than assuming that an ordinary business investment qualifies.

Speed in immigration is produced by specific mechanisms: premium processing where a category offers it, port-of-entry adjudication where a classification permits it, or an expressly expedited process. Before agreeing a fee, ask the reviewer to test the basics: whether the applicant can qualify for lawful permanent residence, whether anything in their history raises admissibility concerns, and whether an EB-1 or EB-2 determination is realistic given visa availability. Under the current official framework, a successful applicant receives lawful permanent resident status as an EB-1 or EB-2 visa holder, which authorizes employment generally; state contractor licensing remains a separate requirement. Higher payment does not change the tests: the applicant must qualify for lawful permanent residence, be admissible, and reach an available visa in the relevant classification, and the gift follows successful vetting rather than producing it.
