Read the general business expansion overview
A new-office management forecast should show how operational duties move away from the transferee as the business develops. A staffing chart becomes useful when the file explains the work each person actually performs and what happens if a planned hire is delayed.
Classify the operation by its business activity
A US organization doing business for less than one year falls within new-office treatment; incorporation or signing a second lease alone does not settle that question. Examine actual regular, systematic and continuous provision of goods or services. Keep the first contract, delivery and invoicing records together so the reviewer can assess the business chronology.
Connect the first-year support to the proposed role
For L-1A, establish sufficient secured premises, a continuous full-time foreign year in managerial or executive capacity within the relevant three years, and the US operation’s ability to support the managerial or executive position within one year. Show the qualifying corporate relationship and continuing business abroad as well. A proposed manager who still performs most delivery tasks needs a substantive role assessment, not simply another title. US days do not count toward the foreign year, although brief visits do not automatically break continuity. Ordinary L-1A can also rely on qualifying foreign specialized-knowledge employment; that does not remove the managerial or executive foreign-year requirement for a new-office L-1A.
Keep changes visible for the later filing
Initial new-office approval cannot exceed one year. Record actual staffing, finances and delegation as they develop, including who covers a vacant position. For an owner or major stockholder, retain evidence addressing temporary US services and the subsequent assignment abroad. An L-1B new-office proposal needs qualifying specialized knowledge, sufficient premises and financial ability to compensate the employee and commence business. Its initial approval is likewise limited to one year; the management plan alone does not establish that different role.
