Greater Sudbury guide: compare EB-5 and Gold Card with an evidence-gap list

USAvisa field guide · 2 minute readReviewed 7 September 2026
THE SHORT ANSWER

Before comparing financial commitments, identify what each framework actually requires and which facts remain unsupported. EB-5 commercial investment and the official Gold Card gift route should not be combined into one generic purchase of residence.

01

Separate the funding record from program eligibility

Hypothetical example: the applicant has a current balance but needs historical records from several institutions. For EB-5, trace the lawful source and path of the proposed capital and assess the actual investment. Do not assume a spreadsheet establishes missing transactions or that a gift proposal resolves every individual eligibility question.

02

Use the correct framework for each comparison

EB-5 involves qualifying capital at risk, participation in management or policy, and at least ten qualifying full-time jobs per investor under the applicable project structure and method. Qualifying limited-partner rights can satisfy the participation requirement without daily operation. Confirm current thresholds and separate fees from capital. Gold Card follows official gift terms subject to applicable EB-1 or EB-2 eligibility, visa availability, vetting and admissibility. The gift should not be presented as a recoverable commercial asset.

03

Identify the next unresolved decision

List the records, current official terms, family questions and independent risk review needed before a commitment. A project presentation and a program summary are starting points, not guarantees of approval or timing. Keep visa availability, household age-related issues and present status visible; neither collected documents nor the ability to pay authorizes an early U.S. move.

04

Distinguish capital, official gifts and residence stages

EB-5’s September 7, 2026 capital minimums are US$1,050,000 or US$800,000 for qualifying targeted employment area or infrastructure projects, with statutory adjustments starting January 1, 2027 according to the petition filing date. Petition approval is not residence: admission on an immigrant visa or approval of adjustment of status starts conditional residence. Later removal of conditions remains necessary, including the usual I-829 filing window in the 90 days before the second conditional-residence anniversary; filing does not itself remove conditions. Gold Card instead describes a nonrefundable US$15,000 fee per person and, after successful vetting and instructions, a government gift of US$1,000,000 individually or US$2,000,000 for a corporate-sponsored employee. Each eligible joining spouse or unmarried child under 21 adds US$15,000 and US$1,000,000. Confirm current corporate maintenance and transfer conditions separately. Neither framework guarantees eligibility, admissibility, visa availability or timing.
