Identify what the US team needs to learn
In a hypothetical assignment, the employee teaches how the company handles unusual exceptions in its internal process. Use genuine examples of the judgment and company information involved. L-1B concerns special knowledge of the organization’s products or services and international application, or advanced knowledge of its processes and procedures. Knowledge need not be unique or proprietary, but a generic training topic does not establish the required character.
Demonstrate knowledge acquired through actual work
Show how the employee learned and applied the process, including completed projects and decisions rather than only years of service. Establish a continuous full-time qualifying foreign year within the relevant three years; US days are excluded, while brief trips do not automatically interrupt continuity. Foreign service may be managerial, executive or specialized knowledge, but the proposed US work must meet the L-1B standard. The qualifying corporate relationship needs separate evidence.
Check delivery and supervision outside the company
If stationed primarily at an unaffiliated worksite, the employee cannot qualify where the unaffiliated employer principally controls and supervises the worker, or the arrangement essentially supplies labour for hire rather than a product or service requiring knowledge specific to the petitioner. A training room at a customer site is not by itself the test. Identify task direction, evaluation and the actual contractual service being delivered.
Support the assignment with operating facts
The qualifying organizations must continue regular, systematic and continuous business in the United States and abroad. If the US organization has been doing business for less than one year, new-office evidence includes sufficient premises, qualifying knowledge and financial ability to pay and commence business; initial approval is limited to one year. Do not assume a scheduled training session proves the US entity is already operating or that the employee has authorization to conduct it.
Explain the actual special or advanced knowledge
General expertise in a widely used controller platform is not specialized knowledge. Use development assignments, training, implementation history and responsibility for difficult work to explain the employee’s knowledge. Where the assignment would place the employee at a client site, say so, because offsite placement carries specific supervision and labour-for-hire restrictions that need a proper legal assessment. Knowledge of a company's own validated processes, its quality management system, its customer-specific qualification protocols and its documented rationale can be special to the organisation even though the underlying standards are public. If any part of the work will be performed at a reinsurer's or vendor's premises, the petition must show the analyst remains controlled and supervised by the petitioning group and is providing the company's own specialized knowledge, not labour for hire. Assess the actual special or advanced knowledge rather than claiming unsupported exclusivity or assuming a colleague’s similar skills decide the case. Where the honest answer is broad familiarity built by time rather than advanced knowledge of the organization's own methods, say so early, while other routes can still be discussed. Training logs, controlled manuals, project records and supervisor evidence can be more useful than generalized adjectives such as unique or critical.
