Select a specific example of applied knowledge

Hypothetical example: an experienced employee has worked with several industry systems but developed advanced familiarity with the employer’s internal integration process. Describe that process, the employee’s contribution and the proposed U.S. application. Avoid relying only on years of experience or a list of products.

Use the proper standard

Specialized knowledge can concern special knowledge of the organization’s products, services or related interests and their international application, or advanced knowledge of its processes and procedures. It need not universally be unique or secret. Explain the actual knowledge without inventing an absolute exclusivity requirement.

Match documents to the individual

Training history, project records, technical explanations and knowledgeable statements may illuminate how the applicant acquired and used the claimed knowledge. A company manual alone does not establish that the applicant possesses it. Identify personal responsibilities and meaningful examples supported by genuine records.

Review the actual U.S. placement

Explain the duties and who directs them. A principal placement at an unaffiliated employer’s worksite requires assessment of control and supervision and whether it is labour for hire rather than a qualifying placement connected to the petitioning employer’s product or service requiring specialized knowledge specific to that employer. Do not assume every customer assignment qualifies or every one is prohibited. The statutory offsite restriction applies when the worker will be controlled and supervised principally by the unaffiliated employer, or when the placement is essentially labour for hire rather than the qualifying product-or-service arrangement.

Complete the foreign-employment and new-office assessment

L-1B generally requires one continuous qualifying year of foreign employment within the relevant preceding three-year period, along with qualifying organizations that meet the doing-business requirements. Assess actual dates and locations; U.S. days do not count toward the foreign year. For a U.S. organization doing business for less than one year, the L-1B new-office evidence includes sufficient premises and financial ability to pay the employee and begin doing business. Initial new-office approval is limited to at most one year. Owners or major stockholders also need evidence of temporary U.S. services and a subsequent foreign assignment.
