Start with the L-1A eligibility and application overview
Map decisions rather than drawing only reporting arrows
In a hypothetical transfer, the employee manages a regional function but must obtain product approval for technical changes. Identify the decisions made independently, the matters escalated and the staff performing routine work. The US role must be primarily managerial or executive. A qualifying function manager acts at a senior level over an essential function with appropriate discretion; simply coordinating everyone else’s decisions or performing the function is insufficient.
Connect the role to the qualifying transfer history
Establish a continuous full-time qualifying foreign year within the relevant three years and the qualifying parent, branch, affiliate or subsidiary relationship. US days do not count toward the foreign year, though brief trips need not interrupt continuity. Ordinary L-1A can use foreign managerial, executive or specialized-knowledge service; the US role must satisfy its managerial or executive standard. Continued regular, systematic and continuous business in the United States and abroad remains required.
Apply new-office conditions only when they fit
A US organization doing business for less than one year is a new office. New-office L-1A specifically needs the qualifying foreign year in managerial or executive capacity, sufficient premises and support for the US managerial or executive role within one year of approval. Initial approval cannot exceed one year. A matrix chart does not demonstrate that support unless the staffing, resources and actual responsibilities make the proposed job credible.
Explain reserved authority without exaggerating the job
Retained board or senior-management approvals should be described rather than omitted. Show meaningful discretion that the applicant actually exercises and identify who performs operational tasks. First-line supervision of nonprofessional workers alone does not establish managerial capacity. If the applicant is an owner or major stockholder, address the required temporary US services and subsequent assignment abroad; ownership cannot replace employment or role evidence.
Managerial and executive describe duties, and the clock runs
An intracompany petition requires a qualifying relationship between the foreign employer and the American entity, as parent, branch, subsidiary or affiliate, evidenced by share registers, purchase agreements and corporate resolutions rather than by an organigram somebody drew. The general maximum for managerial or executive L stay is seven years, subject to the applicable rules and individual facts. A production manager who supervises two shift leads, sets schedules, approves purchasing and hires and disciplines staff is doing managerial work. Managerial duties must be primary; a manager who mostly drives a forklift because the site is short-staffed is not primarily managing. Describe which employees or functions will be managed, their level of discretion, and the transferee’s authority over goals or budgets. A first review maps the foreign and proposed U.S. roles separately, using organization charts, payroll, delegated authority and evidence of the personnel or contractors who perform day-to-day production. The decision is whether the planned operation can support a principally managerial or executive position within that first year, not whether the transferee can personally keep the venture alive.
