Identify the legal entity behind the brand
In a hypothetical offer, a company advertises under one name and issues payroll through an affiliated entity. Ask who is making the employment commitment and how the trading name relates to that entity. Obtain the duties, remuneration and expected duration from the responsible employer. A brand’s reputation does not establish the actual recipient of services or remove a discrepancy in the employment terms.
Assess the profession rather than the corporate label
TN requires Canadian or Mexican citizenship, prearranged temporary professional activity in a listed USMCA profession and its particular qualifications. Canadian permanent residence does not meet the nationality condition. Use authentic credentials and any expressly permitted alternatives; experience cannot universally replace a degree. Degrees from institutions outside Canada, Mexico and the United States require a reliable foreign-credential evaluation, with translation and licensing questions addressed independently.
Explain ownership and customer relationships
Record any affiliate, intermediary or customer arrangements and the applicant’s ownership or control interests. Services to a US entity solely owned or controlled by the applicant are prohibited TN self-employment; an interest in a foreign business alone is not the same rule. Do not assume using an affiliate’s letterhead resolves applicant control of the real US recipient. The evidence should describe the actual arrangement rather than a convenient signing entity.
Align the file with the permission being requested
Canadian citizens generally may request TN admission without a TN visa, while Mexican citizens generally require one. Confirm the appropriate procedure and the temporary nature of the activity. If the legal employer changes, have the effect assessed instead of merely updating a logo on an old letter. Signing an offer or receiving a payroll number does not authorize US work before the required status.
Check the listing's own credential requirement with counsel
The Forester entry is satisfied by a baccalaureate degree or by a state or provincial licence, and those are genuinely alternative routes rather than a combined requirement. A port-of-entry application gives a same-day answer; a Form I-129 petition gives a written approval before travel and suits a file with a prior refusal, an experience-based credential or an ownership stake. Nor does long experience substitute, because the Engineer entry provides no experience alternative; other entries on the list do, which is exactly why the entry has to be read rather than assumed. Marguerite's parchment should be accompanied by a transcript showing an agriculture major, because the profession's rule is a baccalaureate in the field, not any bachelor's degree. The single record that settles a contested field is the institution’s official program description for the year the credential was granted, held by the registrar rather than by the applicant. Order the credential evidence in the sequence a reviewer reads it: the awarding institution, then the program length and completion date, then the experience that the diploma or certificate route requires. Credential requirements vary by profession, so check the exact listing and raise any borderline case with counsel. Preserve the genuine credential rather than translating its title into a qualification the institution did not award.
