NAIRN AND HYMAN · PLANNING GUIDE

Give each prospective employer an accurate citizenship fact

THE SHORT ANSWER

A Nairn and Hyman resident may be discussing US work with several employers. All should receive the same accurate account of citizenship already held, even if one recruiter assumes Canadian residence is sufficient for TN.

01

Separate residence from eligibility

TN principals must be Canadian or Mexican citizens. A Canadian PR card, Canadian degree or pending citizenship application does not satisfy that nationality condition. If the applicant holds Mexican citizenship, assess the corresponding procedure rather than adopting a Canadian process merely because the applicant lives in Ontario.

02

Avoid inconsistent assumptions between employers

Keep citizenship documentation separate from each job’s duties and qualification evidence. One employer’s confidence cannot establish a missing condition for another offer. If TN is unavailable, an L-1 proposal needs qualifying foreign employment, a corporate relationship and eligible US duties. E-2 requires treaty nationality, qualifying ownership, investment and control; neither is a guaranteed alternative.

03

Update the record after real changes

When a new citizenship document is actually issued, reassess the proposal and process. It does not cure nonprofessional duties or missing credentials. Review each family member’s relationship, nationality and intended activity separately. Multiple offers do not produce shared authorization, and a hoped-for citizenship date should not be used as a guaranteed employment start.
