THE SHORT ANSWER

A Nairn and Hyman investor may see a project job report while an employer proposes Gold Card funding. Identify the evidence required from each source and what it leaves unresolved for the applicant.

Test the EB-5 investor’s allocation and capital

At least ten qualifying full-time jobs per investor must be supported under the applicable method without double counting. Trace lawful source and path, qualifying at-risk capital and management or policy-formulation participation. General capital is US$1.05 million or US$800,000 for qualifying targeted employment area or infrastructure cases, with statutory adjustment beginning January 1, 2027 and filing-date rules controlling. A project surplus is not approval or a repayment guarantee.

Itemize the corporate Gold proposal

The published nonrefundable processing fee is US$15,000 per person. Gifts after successful vetting and official instructions are US$1 million individually or US$2 million per corporate employee. Each eligible included spouse or unmarried child under 21 adds US$1 million and US$15,000, including corporate cases. Corporate terms add 1% annual maintenance and 5% transfer with a new background check, not automatic replacement approval. EB-1 or EB-2 eligibility, admissibility and visa availability remain.

Keep residence and financial rights on different timelines

Conditional residence begins on immigrant admission or adjustment approval. A Gold Card gift is not commercial equity or an expected investment return. EB-5 petition approval does not itself grant residence or work permission; after conditional residence begins, I-829 generally is filed in the 90 days before its second anniversary. Filing does not automatically remove conditions or require repayment. Neither a project allocation nor a benefits letter guarantees citizenship or a moving date.
