Describe the decisions behind customer contact
In a hypothetical transfer, the founder negotiates company strategy with key accounts but also prepares quotations and follows up every order. Separate those responsibilities and identify who will perform routine work. L-1A requires primarily managerial or executive duties, with the applicable authority and discretion. A function-manager theory needs a senior role managing an essential function, not simply performing it; first-line supervision of nonprofessional workers alone is insufficient.
Prove the international transfer conditions
Establish the qualifying parent, subsidiary, affiliate or branch relationship and regular, systematic and continuous US and foreign business. The employee needs a continuous full-time qualifying year abroad within the relevant three years; US days are excluded from the count, though brief visits do not automatically interrupt continuity. Ordinary L-1A may rely on foreign managerial, executive or specialized-knowledge employment, while the proposed US position must meet its managerial or executive requirements.
Evaluate the office’s actual operating history
A US organization doing business for less than one year falls under new-office rules. L-1A then specifically requires a managerial or executive foreign year, sufficient premises and support for a primarily managerial or executive US role within one year of approval. Initial approval cannot exceed one year. Explain the staffing and financial support for that plan instead of relying on an old incorporation date or an impressive client list.
Show how owner responsibilities will continue
Use delegated sales work, decision thresholds and operational records to demonstrate the proposed role. If the founder remains responsible for daily fulfilment, disclose the effect on time and duties. An owner or major stockholder must also establish temporary US services and a subsequent assignment abroad under the applicable rule. Neither share ownership nor a board resolution substitutes for qualifying employment or the real distribution of work.
Address a newly established operation
Time already spent in the United States in this classification counts toward the seven-year maximum for a managerial or executive role. If the applicant performs hands-on work, identify it and explain who handles the remaining execution tasks. If the U.S. operation would be newly established, address secured premises and a credible plan for supporting a managerial or executive role within one year, and keep the actual results for the later extension filing. The regulation recognises a parent, a branch, a subsidiary or an affiliate, and affiliation is the one that most often exists here without anyone having planned it. In a service operation the honest question is what proportion of the day is spent directing staff or functions and exercising discretion, and what proportion is spent doing the technical work personally. A managerial or executive position is a defined description rather than a level of seniority, so the redrawn chart should show what the person will actually direct: functions, subordinates or a component of the organisation. Organization charts should identify subordinate supervisors or professionals, while job descriptions, calendars and examples of decisions should show how the applicant allocates resources and directs functions.
