Read the allocation alongside the investment structure

Establish at least ten qualifying full-time jobs per investor without double allocation. Direct positions generally involve at least 35 hours per week, while regional-center evidence may use permitted indirect-job methods under the governing restrictions. The investor, spouse, sons or daughters, nonimmigrant workers and independent contractors do not qualify as direct employees. Ask what method supports the particular allocation and whether the claimed jobs depend on events still projected.

Confirm the actual capital requirement

Generally US$1.05 million is required, or US$800,000 for qualifying targeted employment area or infrastructure investments. Statutory adjustments start January 1, 2027, so apply the petition filing-date rules rather than a reservation date. Capital must qualify as at risk and have lawful source and a documented transfer path. The investor also needs management or policy-formulation participation; qualifying limited-partner rights may satisfy that condition.

Separate project reporting from investor evidence

In a hypothetical offering, a later report revises expected construction activity and the investor list. Request an explanation of the effect on the job allocation rather than assuming the first spreadsheet remains valid. Maintain the applicant’s own source documents and investment records separately. Neither project designation nor a positive report guarantees approval, protects against commercial loss or promises repayment.

Retain evidence through conditional residence

Conditional residence begins on immigrant admission or adjustment approval. Petition approval alone supplies neither residence nor work permission. The immigrant visa or eligible adjustment stage depends on visa availability and individual requirements. After conditional residence begins, I-829 generally is filed in the 90 days before the second anniversary; filing is not automatic removal of conditions or a repayment trigger. Review spouse and unmarried-child eligibility and applicable CSPA dates independently of the project’s reporting timetable.

Investment amount, targeted employment area and job creation

The standard qualifying amount is 1,050,000 dollars, reduced to 800,000 dollars for a targeted employment area or an infrastructure project under the 2022 reform legislation; verify the current figures before committing. Choosing a targeted employment area, whether a high-unemployment area or a rural area under the current definitions, lowers the capital threshold, and the designation must be established with the evidence the regulations require at the time of filing, not assumed from the town's character. Form I-829 is filed within the ninety days immediately before the two-year conditional period expires, and it asks for proof that the enterprise was sustained and that the required employment was created or, in some circumstances, will be created within a reasonable time. A direct investment counts jobs created directly by the new commercial enterprise, including through qualifying wholly owned subsidiaries; a regional-centre investment may also count indirect jobs under an approved economic methodology, which is why the same restaurant group can look different under the two structures. A statutory exception permits a buyback solely at the enterprise’s discretion, but exercise requires petition withdrawal unless applicable sustainment and other requirements are fulfilled. Evaluate the project documents on their own terms: subscription provisions, risk disclosures, deployment mechanics, and the stated job-creation methodology. The route leads first to conditional permanent residence when the relevant petition and admission or adjustment steps succeed; conditions are not removed simply because money was transferred. A standalone case usually means direct involvement in an operating business and direct responsibility for its records; a regional centre case usually means reliance on a sponsor's reporting.
