Start with the L-1B eligibility and application overview
Use a migration problem to explain the claim
In a hypothetical project, the employee knows how legacy configurations affect the company’s new platform. Identify the company-specific reasoning used to preserve compatibility, and distinguish it from general installation skill. L-1B concerns special knowledge of the organization’s offering and international application, or advanced knowledge of its processes and procedures. Knowledge need not be unique or proprietary, but the employee’s tenure alone does not establish that standard.
Reconcile completed experience with new training
Describe the employee’s actual work history, training and independent application of the claimed knowledge. Do not present a planned course on the new release as completed experience. Establish the qualifying corporate relationship and a continuous full-time foreign year within the relevant three years, excluding US days while recognizing that brief visits need not break continuity. The qualifying foreign capacity may be managerial, executive or specialized knowledge; the US role must fit L-1B.
Inspect customer-site supervision and delivery
For an employee stationed primarily at an unaffiliated worksite, L-1B is unavailable if the unaffiliated employer principally controls and supervises the employee, or the arrangement is essentially labour for hire rather than a product or service requiring knowledge specific to the petitioner. Identify who assigns migration tasks and evaluates work. Canadian payroll and an internal job title do not answer the off-site conditions.
Complete the organization’s operating evidence
The qualifying organizations must continue regular, systematic and continuous business in the United States and abroad. A US organization doing business for less than one year needs the new-office showing: sufficient premises, qualifying knowledge and financial ability to pay the employee and commence business, with initial approval limited to one year. Match the actual assignment to those resources rather than assuming a product launch establishes an operating office.
Prove the qualifying employee and organization history
A specialist who learned a company process during assignments in several countries needs an accurate account of both the knowledge and the qualifying employment. A first review should make an individual knowledge matrix showing what the employee learned, where it was applied, why it matters to the related U.S. business, and what documents corroborate it. The transferee must remain controlled and supervised by the petitioning employer, performing duties that involve the company's specialised knowledge, not filling a staffing need for the customer. L-1B focuses on specialized knowledge of the petitioning organization’s products, services, research, equipment, techniques, management, or other interests and their application in international markets. Obtain training history, project records, controlled procedures and supervisors' explanations, then connect each record to a particular capability. Familiarity with a widely used tool does not by itself resolve the organizational-knowledge or placement questions. Branding alone does not establish that knowledge remains applicable, and a name change alone does not prove the employee must learn an entirely different system. The decision maker needs a comparison between standard industry skill and the applicant’s developed understanding of the organization’s methods.
