A material change in tasks or required methods should be reviewed against the employee’s actual knowledge and proposed arrangement.

Determine whether the same evidence still supports the work and whether client control changes. A project substitution does not grant work permission or automatically preserve the validity of an earlier analysis.

A work start date does not cure an arrangement where the unaffiliated employer principally controls and supervises the worker, or one that is essentially labor for hire rather than a product or service requiring knowledge specific to the petitioner. List the remaining tasks, connect each one to special knowledge concerning company products or advanced familiarity with internal processes, and remove obsolete language from the support letter. Order matters: the qualifying parent, branch, subsidiary or affiliate relationship and the year abroad are historical facts fixed before filing, while the assignment description is the piece still being written. Preserve the corporate link, one continuous full-time year abroad in a managerial, executive, or specialized-knowledge capacity within the relevant preceding three-year period, and, outside the special U.S. new-office rules, both-country operations.
