Distinguish completed delegations from planned ones and support each stage with dated records. Do not portray a future hire as existing staff.

Use a responsibility and evidence table

For each recurring activity, name the current performer, proposed replacement, transfer date and available proof. Include the effect of an unfilled role on the transferee’s duties. That table can connect contracts, payroll, training and financial plans to the proposed management assignment.

The closing set: the executed purchase agreement, the share register or membership ledger showing the Canadian company as owner, the U.S. entity's formation and registration records, and evidence that both businesses are actively trading. Deal counsel or the corporate secretary holds share transfers and resolutions; the acquired company's payroll provider may hold records the buyer never received; a departed manager may be the only person who can explain a numbering change. Eligibility still requires a parent, branch, subsidiary, or affiliate relationship, one continuous year of full-time foreign employment in a managerial, executive, or specialized-knowledge capacity within the relevant preceding three-year period, and primarily managerial or executive U.S. duties. A role that has lost subordinates may have gained responsibility for an essential function, a budget, a supplier programme or a production line, and that is a different claim supported by different documents: approval limits, budget ownership, contracts signed, decisions recorded.
