Build the replacement household from its own facts
Identify relationships, ages and who intends to join; assess any CSPA issue on the actual case record. The official FAQ recommends initial inclusion, but does not promise synchronized decisions or automatic treatment of later additions. Immigrant-visa derivatives must enter with or after the principal. A corporate transfer should not be described as transferring one family’s eligibility to another.
List each family member's status under the existing employer-sponsored case, if any, including any derivative priority date or pending adjustment, and separately confirm the current Gold Card per-person costs and requirements. Record the change and seek the correct current instructions; do not invent a universal rule that everyone must withdraw together or that remaining family members automatically continue unaffected. An adult child, a partner who is not legally married, a stepchild, a child approaching twenty-one, or a family member with their own immigration history each deserve an individual answer rather than an inference from the general description.
