A qualifying spouse in appropriate L status may work incident to that status with the required evidence. The principal’s role classification and the spouse’s documentation are separate questions.
Verify the household’s actual records
Dependent eligibility generally concerns a spouse and unmarried children under 21. Children do not receive the spouse employment permission. Check the admission and identity records for each person before a spouse starts an intended job; an EAD is not universally required for a qualifying L spouse. A company’s relocation package or approval of the principal’s transfer does not replace the family member’s own status evidence.
Of the routes described on this site, L-1 treats an accompanying spouse most generously, and employers ordinarily rely on the annotated Form I-94 issued on admission when completing onboarding paperwork. Where the filing date may move on legal advice, avoid decisions the household cannot unwind: notice on housing, a resignation by a spouse, or a school place that must be accepted by a fixed date. Where a spouse expects to work, discuss their position specifically rather than assuming it follows from the principal's case, and avoid long leases or resignations agreed before the structure is settled.
