Reassess how the transferee would actually spend time. A delay that shifts routine operating work onto the applicant can affect the managerial-role analysis.
Update the work allocation before relying on it
Document which appointments are effective and which remain planned. In a new-office case, the initial period is no more than one year, with the required role supported within one year of approval; an amended recruitment forecast does not extend that period automatically. Use actual operational progress for the next review instead of retaining a chart that no longer describes the business.
L-1A timing depends on the qualifying employment record and the proposed petition, while a new office must show sufficient physical premises and a credible development plan for the executive or managerial role. L-1A requires qualifying organizations that are doing business, a managerial or executive U.S. position, and twelve continuous months of qualifying employment abroad during the relevant preceding thirty-six months. A common error is transferring Canadian authority too early, then discovering the applicant no longer performs the documented foreign role while the American operation remains unable to support management.
