Does paying the project deposit before 2027 fix the lower threshold?

THE DIRECT ANSWER

Do not assume that it does. The applicable EB-5 investment threshold depends on the petition filing date and qualifying investment category.

Separate capital, administrative charges, professional fees and other expenses. The current US$1,050,000 and qualifying US$800,000 thresholds are subject to scheduled adjustment beginning January 1, 2027. A contractual deposit date is not a substitute for the immigration filing-date analysis.

Government filing fees at the amounts published in the USCIS fee schedule, Form G-1055, and professional costs that are substantial in a direct investment: independent legal advice, source-of-funds preparation, business valuation, and an economist's or accountant's work on the job-creation plan. Verify current government amounts officially rather than relying on figures quoted in older material, and treat any promise of a particular outcome as a warning sign rather than as a reassurance about value for money. Professional costs are driven largely by the source-of-funds work, which in this scenario spans a company, a donor and several years of records, and by the due diligence a sensible investor commissions on the project itself.
