No. The employee still needs the applicable EB-1 or EB-2 basis, admissibility, vetting and visa availability.
Separate two approvals
The employer can approve a benefits expense, but the immigration authorities determine the case. Identify the named applicant and the official corporate process rather than assuming a general relocation allowance is equivalent to a completed sponsorship. An offer should not represent payment capacity as guaranteed residence or citizenship.
A nonrefundable processing fee of fifteen thousand United States dollars per person, successful vetting, and then a gift of one million United States dollars paid by the applicant to the U.S. government, or two million where a corporate sponsor gives on the person's behalf. The programme operates through existing employment-based first and second preference classifications rather than replacing them, so the requirements of the underlying category continue to apply alongside the processing fee, the vetting and the gift. Because the case ultimately rests on an existing category, the ordinary conditions of that category continue to apply: admissibility, the medical examination, the security and background review and the availability of a visa number under the visa bulletin. The school’s decision speaks to academic admission and to nothing else; it establishes neither the child’s immigration category, nor the relationship, nor admissibility, and no school can widen a published family definition.
